Issues arising around Prop 65 compliance, the "right to know statute" that covers more than 800 chemicals known to cause reproductive harm or cancer,  have resulted in numerous Notices of Violation and more than 200 Putative Class Action suits. Proper labeling and advertising strategies are necessary to insure compliance to State and Federal laws, while careful examination of claims on labels and in advertising can prevent unnecessary litigation under California’s numerous Consumer Protection Laws. Methods for working successfully with various regulating bodies at the State, Federal and International levels will be discussed.


Don Frey, Product Development & Innovation Consultant

Don brings over 30 years of experience in consumer product development across a broad range of categories including skin care, color cosmetics, personal care, fine fragrance, home fragrance, nutritional supplements and OTC drugs.  Don’s career began at Proctor&Gamble working in hair care on the Pert Plus brand and then he spent two years in Japan launching P&G’s entry into personal care in Asia.  Later, Don became technical lead in the integration of Noxell into P&G, where he managed the Cover Girl brand and launched the first foundations for women of color.  Don subsequently moved West to join Jafra Cosmetics International,  then a Gillette subsidiary,  as VP of R & D. He later joined Avon, heading R & D and Product Development worldwide, where Avon’s unique selling platform required creating between 2500 to 3500 new sku’s per year for sale in 122+ countries.  Don has spent the last five years as VP of Product Development at Method, the innovative Green Marketing start-up where he built a stable of personal care and cleaning products which redefined categories and challenged market leaders.  In the course of these various responsibilities, Don has dealt with the FDA, FTC and EPA at Federal, State and Local levels, as well as MHW, COLIPA, NICNAS, and CFDA among others. He is now in demand as a Consultant and Innovator in the consumer products industry.


Amy Burke, JD

Amy is a lawyer with Conkle, Kremer  &  Engel, a Law Firm specializing in personal care serving manufacturers and distributors, salons and retailers, from smaller startups to large private and public companies.  Amy’s area of specialty includes cosmetics, fragrance, skin care, and personal care. Her clients are beauty and fragrance firms, fashion and clothing designers, nutritional supplements and electronic manufacturers including litigation of trademark and copyright infringement, false advertising, unfair competition as well as registration and protection of intellectual property. Amy focuses on protection of non-traditional trademarks such as fragrance and color as well as issues involving language analysis in branding and advertising, and she was a co-presenter at PCPC’s Emerging Issues Conference in November, 2012.  Amy has a B.A. from the University of Michigan in Philosophy and Linguistics, a Masters in Philosophy from the University College London, and her J.D. from UCLA Law School.
